1. Acceptance of Terms
By accessing or using SwiftBuilder, you agree to these Terms of Use and to our Privacy Policy.
If you do not agree with these Terms, do not use the application or related services.
If you use SwiftBuilder on behalf of a company, organization, or other entity, you represent that you have authority to accept these Terms on its behalf.
2. SwiftBuilder Service
SwiftBuilder provides software-development tools intended to help users create, inspect, modify, learn, preview, and work with Swift-based applications.
Depending on the version and plan you use, features may include AI-assisted code generation, SwiftUI preview, workspace functionality, learning resources, AI tutoring, project management, compiler diagnostics, and related development features.
Features may change over time. Some functionality may be available only on particular devices, operating-system versions, or subscription plans.
3. Accounts
Certain features may require an account.
You are responsible for maintaining the security of your account credentials and for activity performed through your account.
You agree to provide information that is reasonably accurate when an account requires such information and to update it when necessary.
Do not share account credentials in a way that allows unauthorized access to another person's account or projects.
4. Generated Code and Content
SwiftBuilder may generate source code, UI implementations, explanations, project structures, documentation, suggestions, or other content in response to your instructions.
Subject to applicable law and the rights of third parties, you may use and modify code generated for you by SwiftBuilder for your own projects.
You are responsible for determining whether generated content is suitable for your intended use and whether its use complies with applicable laws, licenses, intellectual-property rights, platform requirements, and third-party terms.
AI-generated code may contain bugs, security problems, incorrect assumptions, licensing issues, deprecated APIs, or behavior that does not match your requirements. Always review, build, test, and validate generated code before using or distributing it.
5. AI-Assisted Features
SwiftBuilder uses AI-assisted systems to provide certain features.
AI output is generated algorithmically and may be incomplete, inaccurate, outdated, or inappropriate for a particular purpose.
You should independently verify important technical, security, financial, legal, or other consequential information before relying on it.
No guarantee of a particular result
We do not guarantee that an AI request will produce a particular implementation, compile successfully, satisfy a particular design requirement, or remain available without interruption.
Your responsibility
You remain responsible for the final software you build, including its code, dependencies, permissions, security, privacy practices, third-party services, content, and compliance with Apple's requirements and applicable law.
6. Acceptable Use
You may use SwiftBuilder only for lawful purposes and in accordance with these Terms.
You must not use SwiftBuilder to:
- Violate applicable laws or regulations.
- Infringe another person's intellectual-property, privacy, or other rights.
- Attempt to gain unauthorized access to accounts, systems, services, or infrastructure.
- Circumvent usage limits, subscription restrictions, authentication, security mechanisms, or other technical protections.
- Interfere with the operation or security of SwiftBuilder.
- Upload or transmit malicious code intended to damage, compromise, or disrupt systems.
- Abuse automated interfaces or infrastructure in a manner that creates unreasonable load.
- Use SwiftBuilder to create or distribute content that violates applicable law or third-party rights.
We may take reasonable action when misuse threatens the security, availability, or integrity of the service or its users.
7. Subscriptions and Credits
SwiftBuilder may offer free plans, paid subscriptions, credits, or other usage-based features.
Subscriptions
Paid subscriptions may automatically renew unless cancelled according to the applicable App Store subscription settings and terms.
Pricing, billing periods, available plans, introductory offers, trials, and other commercial terms are presented through the applicable purchase interface.
Credits and usage limits
Some features may consume credits or be subject to usage limits.
Credit costs and limits may differ by feature and may change as the service evolves.
Credits are intended for use within SwiftBuilder and are not cash, currency, or a transferable financial asset.
Purchases through Apple
If a subscription or digital purchase is made through Apple's App Store, the transaction is subject to Apple's applicable payment, subscription, and platform terms.
8. Apple App Store
SwiftBuilder's iOS application is distributed through Apple's App Store and is subject to Apple's applicable terms and requirements.
Apple's agreements govern the relationship between Apple and developers concerning App Store distribution and related developer services. Apple also provides a standard EULA for applications where a developer does not provide a custom EULA.
Nothing in these Terms is intended to replace or modify Apple's own agreements, terms, or policies that apply to your use of Apple's services.
Apple may require developers to maintain accurate application information, including privacy-policy information and other App Store metadata.
9. Third-Party Services
SwiftBuilder may integrate with or rely upon third-party services, including hosting, authentication, AI processing, storage, analytics, payment, or other infrastructure.
Third-party services may have their own terms and privacy policies.
Your use of a third-party service may therefore be subject to that provider's separate terms.
We are not responsible for independent third-party services that are outside SwiftBuilder's control.
10. Intellectual Property
SwiftBuilder
SwiftBuilder, its branding, visual design, website content, software, and underlying technology are owned by SwiftBuilder or its licensors and are protected by applicable intellectual property laws.
These Terms do not transfer ownership of SwiftBuilder's underlying software, trademarks, branding, or proprietary technology to you.
Your content
You retain your rights in content that you provide to SwiftBuilder, subject to the rights and permissions necessary for SwiftBuilder and its service providers to process that content in order to provide the requested service.
Third-party content
You are responsible for ensuring that code, images, libraries, datasets, APIs, trademarks, and other third-party materials used in your project are properly licensed or otherwise permitted.
11. Service Availability
We aim to keep SwiftBuilder useful and available, but we do not guarantee uninterrupted or error-free operation.
Features may occasionally be unavailable because of maintenance, software updates, infrastructure problems, third-party provider issues, network conditions, capacity limitations, security incidents, or other circumstances.
We may add, modify, suspend, or discontinue features as the product evolves.
12. Disclaimer
SwiftBuilder is provided on an "as available" and, to the extent permitted by applicable law, "as is" basis.
To the maximum extent permitted by law, SwiftBuilder does not make warranties that the service will always be available, uninterrupted, secure, accurate, or suitable for a particular purpose.
We do not guarantee that generated code will compile, be secure, satisfy your requirements, or be accepted by Apple's App Review process.
You are responsible for reviewing generated software, testing it on appropriate devices, checking dependencies and licenses, protecting secrets, and ensuring that your final application satisfies Apple's requirements and applicable law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, SwiftBuilder and its operators, affiliates, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the service.
This may include loss of data, revenue, profits, business opportunities, or other intangible losses, to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
14. Suspension and Termination
You may stop using SwiftBuilder at any time.
We may suspend or terminate access to the service where reasonably necessary to address security issues, abuse, violations of these Terms, legal requirements, or operational risks.
Where appropriate and reasonably practical, we may provide notice before taking action.
Termination does not eliminate provisions that by their nature should continue to apply, including provisions concerning intellectual property, disclaimers, limitations of liability, and dispute-related obligations.
15. Changes to These Terms
We may update these Terms when the service, features, business model, technology, or legal requirements change.
When changes are made, the effective date at the top of this page will be updated.
Continued use of SwiftBuilder after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
